Cho Nam-sug, director of the National Solidarity for Judiciary Reform, has lived an unusual life fighting against law enforcement authorities and malfunctioning judicial systems over the last two decades. The 51-year-old female activist even changed her name to Cho Gwan-sun, a symbolic name that echoes that of Yu Gwan-sun, who fought for the nation¡¯s independence during the period of Japanese colonial rule, in order to express her determination to resist the nation¡¯s dilapidated judiciary systems. A book she published in July includes the names of some 40 dishonest and incompetent lawyers and detailed information concerning lawsuits as well as copies of related legal documents. ``After gathering information about the victims of unfair law suits over the last few years, we have found that lawyers have caused a series of problems,¡¯¡¯ Cho told The Korea Times. ``I believe both the professional abilities and the morality of lawyers need to be greatly improved before the ongoing judiciary reform can be completed successfully.¡¯¡¯ Cho has helped the victims of some 70 lawsuits during the last 10 years. She had organized countless rallies for the victims and it has become part of her life to accuse lawyers or judiciary officials of dishonesty and be sued by them. Cho is currently trying to help the bereaved family of a person who died of cancer in prison due to a lack of proper medical treatment, aiming to obtain proper compensation from the government and related lawyers. The victim, who had suffered from liver cancer in the past, was given a 30-month prison term after lending her name for the president of a bogus company, which later went belly up intentionally, leaving her responsible for all the resulting financial damages. For each case, many of which take longer than a year to be completed, her clients pay less than 1 million won, far lower than the minimum of 3 million won one can expect to pay to get help from a lawyer. Most of the money is spent on holding street demonstrations, Cho said. The civic group also set up in July a center to receive calls from victims of unfair lawsuits, the first of its kind in Korea. Cho said the center receives around 10 calls per week. ``It is so hard to find volunteers as we are often considered to be very wild and even a bit militant by the public. We need volunteer workers in order to continue our activities with such a low budget,¡¯¡¯ Cho said. ``With the new law school system, we hope law majors get first hand experience through working at civic groups and other facilities such as detention centers.¡¯¡¯

Corruption involving prosecutors, judges and lawyers has drawn keen media attention nationally, but little effort has been made to establish legal measures to curtail the problem, according to legal experts. The most recent case came from Chunchon, located some 150 kilometers east of Seoul, with a sex scandal involving a judge of the district court and other powerful men of the city. According to initial investigations, more than a dozen senior prosecutors, lawyers and judges may have had sex with female employees of an upmarket bar in downtown Chunchon, with a lawyer financing the secret meetings in return for favors. ``Every year, corruption scandals involving those practicing and enforcing the law occur to the disappointment of the public, which expects them to be the last ones to commit crimes,¡¯¡¯ said Lee Mi-gyeong, an official of the anti-corruption bureau of the People¡¯s Solidarity for Participatory Democracy. ``Most cases are revealed by witnesses,¡¯¡¯ Lee said. ``Until now, judges have regularly met privately with lawyers and plaintiffs, but no rule has been prepared to tackle this practice. This leads to wrongdoings every year.¡¯¡¯ Civic groups have increased their efforts to monitor suspicious activities in legal circles, while also demanding that the government and the National Assembly get tougher with such cases. According to the Judiciary Reform Committee under the Supreme Court, lawyers who were previously judges or prosecutors tend to use personal links with judges and prosecutors in trials. Rulings have often been marred by judges¡¯ relationships with lawyers. ``People doubt the fairness of rulings if the lawyers involved were previously judges. This damages the reputation of those involved in law among the public,¡¯¡¯ said Cho Jun-hee, a committee member. Preventing these practices has been a top priority of judicial reform, Cho said, adding that many other measures will be taken to prevent corruption in legal circles. The committee plans to establish an independent commission to monitor corruption cases involving lawyers and invite civic representatives to determine the level of punishment for those found to have committed wrongdoings. The committee is consulting with lawyers¡¯ groups and the prosecution to finalize the details of the measure. The committee is also considering the regulation of the activities of brokers, who receive payments from lawyers in return for introducing plaintiffs. South Korea has generally been lenient to judges, prosecutors and lawyers for their misconduct due to cozy relationships that protect their interests. In most cases, those who violate ethical codes simply resign and get a simple slap on the wrist, legal experts say. Civic groups have called for a legal framework to punish judges who have private contact with litigants and prosecutors. They argue that stricter punishment would lead to a cleaner legal society, but their views have not been reflected in the reform measures. ``The problem is that privileged people don¡¯t want to take responsibility and just enjoying playing above the reach of ordinary people,¡¯¡¯ according to an official from the Clean Korea Foundation, a group dedicated to monitoring corruption in officialdom and business circles. ``They tend to pay little attention to the wrongdoings of individuals in the same field. The relationships are so strong that they are not easily broken. Only the public can act to correct this problem.¡¯¡¯ In the Chunchon case, while investigators initially closed the case citing a lack of evidence, it drew the attention of the Korea Independent Commission Against Corruption after some individuals claimed they had sold sex to the judge and the lawyers. The case is now under the scrutiny of the Supreme Public Prosecutors¡¯ Office in Seoul as the commission demanded a proper investigation. ``This case may end up to be a storm in a teacup, but the damage to the reputations of the people concerned is irreversible,¡¯¡¯ a commission official said. ``The significance of this case will depend on how those in legal circles respond. We hope this case will serve as an example for tackling deep-rooted problems in Korean legal circles.¡¯¡¯
